Hearing about Legal
Drain vacation, and ac-
ceptance of reconstruction
To be heard at 6pm,
July 7th, 2026, at its
stated meeting of the
Johnson County Drainage
Board.
Notice is hereby given
pursuant to I.C.
36-9-27-37, that the De-
veloper for Ridgetop re-
quested a reconstruction
of the Shirley Regulated
Tile on June 6th, 2021. At
its June 6th, 2021, meet-
ing the County Surveyor
reclassified the Shirley
Tile to an Urban Drain,
and reconstruction was
approved with the total
project cost at the ex-
pense of the Ridgetop De-
veloper. A Hearing for The
Revised Reconstruction
and Relocation was heard
and accepted at the No-
vember 9th, 2023, John-
son County Drainage
Board.
The Johnson County
Surveyor, seeing that the
construction is complete,
is now ready to recom-
mend that the Johnson
County Drainage Board
accept the Reconstructed
Regulated Drain, and va-
cate the tile drain known
as Shirley Urban Drain.
This drain as recon-
structed is along the East
side of the Mackerodt Par-
cels No. 41-02-26-013-
004.000-023 and No.
41-02-26-013-004.001-023 and along the North side
of Mackerodt Parcel No.
41-02-26-013-004.001-023. This new drain being lo-
cated on the East side of
Combs Road approxi-
mately 2000-foot South of
County Line Road, in Sec-
tion 24 Township 14 North
Range 4 East, Green-
wood, Johnson County,
Indiana.
Notice: That no less
than ten (10) days before
the boards hearing on a
Shirley (Urban) Tile Legal
Drain Vacation, an owner,
or owners agent, of lands
affected by vacation of
Shirley Tile must file with
the board written objec-
tions. Each objector may
file written evidence in
support of the objectors
objections. The failure of
an owner to file written ob-
jections constitutes a
waiver of the owners right
to subsequently object, on
the grounds stated in this
subsection, to any final ac-
tion of the board. On or
before the day of the hear-
ing, the county surveyor
shall, and any owner of
land affected by Shirley
(Urbon) Tile Vacation,
may, cause written evi-
dence to be filed in sup-
port of or in rebuttal to any
objection filed under sub-
section. The board shall
consider the objections
and evidence filed, may
adjourn the hearing from
day to day or to a specific
day certain, and may is-
sue an order permitting
additional written evidence
to be filed in support of or
in rebuttal to the objec-
tions and evidence previ-
ously filed.
Written questions, con-
cerns, and objections
must be written and re-
ceived prior to hearing in
care of the county survey-
ors office.
In accordance with the
Americans with Disabili-
ties Act, if anyone wishes
to attend the public hear-
ing on the above refer-
enced matter and is in
need of reasonable ac-
commodation in order to
attend, hear, or present
evidence, at the public
hearing on this matter,
please contact the Drain-
age Board secretary so
accommodation can be
