NOTICE OF INTENT TO
REQUEST RELEASE OF
FUNDS
FOR TIERED PROJECTS
AND PROGRAMS

On or after April 13,
2025 the City of Franklin
will submit a request to the
Indiana Office of Commu-
nity and Rural Affairs for
the release of Community
Development Block Grant
Entitlement funds under
Title I of the Housing and
Community Development
Act of 1974 as amended,
to undertake the following
project:
Tier 1 Broad Review
Project/Program Title: City
of Franklin Owner - Occu-
pied Rehabilitation
Program.
Purpose: The program
will assist in the rehabilita-
tion of approximately 20
homes for income quali-
fied homeowners.
Location: The owner-
occupied housing units will
be located withing the in-
corporated boundaries of
the City of Franklin.
Project/Program De-
scription: The project is a
scattered site rehabilita-
tion of owner-occupied
housing units. The reha-
bilitation consists primarily
of roofing replacement,
HVAC replacement, elec-
trical upgrades, water
heater replacement and
accessibility modifications
to the threshold of the
home for income qualified
homeowners residing
within the corporate limits
of Franklin, IN.
Tier 2 site specific re-
views will be completed
for those laws and authori-
ties not addressed in the
tier 1 broad review for
each address under this
program when addresses
become known.
Level of Environmental
Review Citation: The cate-
gorical exclusion citation
under which the City of
Franklins Rehabilitation
Program of homeowner
occupied single family
homes is: 24 CFR Part
58.35(a)(3)(i)
Tier 2 Site Specific Re-
view: The site-specific re-
views will cover the follow-
ing laws and authorities
not addressed in the Tier
1 broad review: The
site-specific reviews will
cover the following laws
and authorities not ad-
dressed in the Tier 1
Broad Level Review in-
cluding: Airport Hazards,
Floodplain Management
and Section 106 Historic
Properties Review.
Mitigation Measures/
Conditions/Permits (if
any): For the laws and au-
thorities listed in the Tier 2
site specific review will ad-
dress the issues as fol-
lows: Airport Hazards,
map with location of site to
determine applicability;
Flood Insurance, property
owner will be requested to
provide insurance of prop-
erty and program adminis-
trator will determine if
flood insurance is re-
quired; Floodplain Man-
agement, map with loca-
tion of site will be obtained
from FEMA or DNR Divi-
sion of Water; and historic
properties-Section 106
Review of the site will be
conducted including corre-
spondence with the Indi-
ana Department of Natural
Resources, State Historic
Preservation Officer.
Estimated Project Cost:
$350,000.
The activity/activities
proposed are categorically
excluded under HUD reg-
ulations at 24 CFR Part 58
rom National Environ-
mental Policy Act (NEPA)
requirements per 24 CFR
Part 58.5(a)(3)(i). An Envi-
ronmental Review Record
(ERR) that documents the
environmental determina-
tions for this project is on
file at Franklin City Hall,
Mayors Office, 70 E Mon-
roe Street, Franklin, IN
46131 and may be exam-
ined or copied weekdays
8:00 A.M to 4:00 P.M.,
Monday through Friday.
PUBLIC COMMENTS
Any individual, group,
or agency may submit
written comments on the
ERR to the Franklin City
Hall, Mayors Office, 70 E
Monroe Street, Franklin,
IN 46131. All comments
received by April 12, 2025
will be considered by the
City of Franklin prior to au-
thorizing submission of a
request for release of
funds.
ENVIRONMENTAL
CERTIFICATION
The City of Franklin cer-
tifies to the Indiana Office
of Community and Rural
Affairs (OCRA) that Steve
Barnett, Certifying Officer,
in his capacity as Mayor
consents to accept the ju-
risdiction of the Federal
Courts if an action is
brought to enforce respon-
sibilities in relation to the
environmental review
process and that these re-
sponsibilities have been
satisfied. The States ap-
proval of the certification
satisfies its responsibilities
under NEPA and related
laws and authorities and
allows the City of Franklin
to use HUD program
funds.
OBJECTIONS TO RE-
LEASE OF FUNDS
The State will accept
objections to its release of
fund and the City of
FFranklin certification for a
period of fifteen days fol-
lowing the anticipated sub-
mission date or its actual
receipt of the request
(whichever is later) only if
they are on one of the fol-
lowing bases: (a) the certi-
fication was not executed
by the Certifying Officer of
the City of Franklin; (b) the
City of Franklin has omit-
ted a step or failed to
make a decision or finding
required by HUD regula-
tions at 24 CFR part 58;
(c) the grant recipient or
other participants in the
development process
have committed funds, in-
curred costs or under-
taken activities not author-
ized by 24 CFR Part 58
before approval of a re-
lease of funds by State; or
(d) another Federal
agency acting pursuant to
40 CFR Part 1504 has
submitted a written finding
that the project is unsatis-
factory from the standpoint
of environmental quality.
Objections must be pre-
pared and submitted in ac-
cordance with the required
procedures (24 CFR Part
58, Sec. 58.76) and shall
be addressed to OCRA,
Environmental Officer,
One North Capitol, Suite
600, Indianapolis, IN
46204-2288. Potential ob-
jectors should contact
OCRA, Environmental Of-
ficer, to verify the actual
last day of the objection
period.
