AN ORDINANCE
PROHIBITING THE
UNAUTHROIZED
REMOVAL
OR TAMPERING WITH
BARRICADES OR
TRAFFIC CONTROL
DEVICES IN
JOHNSON COUNTY,
INDIAN
A

WHEREAS, the safety
and welfare of the public
are of the utmost concern
to the Johnson County
Board of Commissioners;
WHEREAS, the public
rights-of-way, roadways,
and public spaces are
maintained by the County
in a manner that protects
users;
WHEREAS, barricades
and other traffic control
devices are lawfully
placed by
the County and/or its
authorized agents to close
or restrict access to public
areas,
including streets and
sidewalks, due to con-
struction, maintenance,
public events,
inclement weather, or
other necessary purposes;
WHEREAS, it is nec-
essary and appropriate to
enact regulations prohibit-
ing the
unauthorized removal
or interference with barri-
cades and other traffic
control
devices in order to pro-
mote public safety, ensure
compliance with lawful
closures,
and preserve the integ-
rity of County infrastruc-
ture and emergency re-
sponse
protocols; and
WHEREAS, this Ordi-
nance does not rescind or
conflict with any previous
ordinances, state stat-
ute, or federal law estab-
lishing any other transfer
fee or service.
NOW, THEREFORE,
BE IT ORDAINED BY
THE BOARD OF COM-
MISSIONERS OF JOHN-
SON COUNTY, INDIANA:
The Johnson County
Code is hereby amended
by the addition of 9
9-1-7 et seq.
SECTION 1. 9-1-7-1.
Purpose
The purpose of this
chapter shall be to protect
the safety of the public
and County by prohibiting
unauthorized removal,
movement, or tampering
with barricades or other
traffic control devices law-
fully placed by the County
or its agents.
SECTION 2. 9-1-7-2
Definitions
The following definitions
apply to this Chapter:
A. Barricade shall
mean any physical struc-
ture, device, or sign
placed to restrict or block
access to a public
right-of-way.
B. Traffic Control De-
vice shall mean all signs,
cone, barrels, barriers, or
other objects placed by or
at the direction of the
County, its departments,
or law enforcement for the
purpose of regulating or
guiding traffic or ensuring
public safety.
C. Unauthorized re-
moval or tampering shall
mean any moving, remov-
ing, altering, or otherwise
interfering with a barricade
or traffic control device
without express permis-
sion from the County.
SECTION 3. 9-1-7-3 Vi-
olations
A. No person shall en-
gage in the unauthorized
removal or tampering with
a barrier or traffic control
device placed by or on be-
half of the County.
B. This section shall not
apply to any emergency,
maintenance, law enforce-
ment, fire, public utility,
government agency or
medical services vehicle
then responding to a serv-
ice call, and any employ-
ees of any of the above
exempt services, if en-
gaged in performing their
respective duties.
Section 4. 9-1-7-4 En-
forcement
The Johnson County
Sheriffs Office shall be
charged with enforcing all
provisions of this Chapter.
SECTION 5. 9-1-7-5
Penalties
Johnson County Sheriff
officers shall issue an Or-
dinance Violation to any
person violating a provi-
sion of this Chapter in the
following amounts which
shall be processed by and
paid to the Johnson
County Clerk and depos-
ited to Johnson County
Johnson County Ordi-
nance Fines Fund No.
4201 as follows:
A. Any person who en-
gages in behavior in viola-
tion of this section shall be
fined in an amount not to
exceed One Hundred Dol-
lars ($100.00) for such of-
fense.
B. Any person who en-
gages in behavior in viola-
tion of this section during
a travel advisory or emer-
gency declared by the
Board of County Commis-
sioners pursuant to John-
son County Code
10-2-1-1 et seq., shall be
fined in an amount not to
exceed Five Hundred Dol-
lars ($500.00) for each of-
fense.
C. In addition to the
penalty imposed by this
section, violators may be
held liable for any dam-
ages or costs incurred by
the County as a result of
the violation, including
emergency response and
repair.
Section 6. 9-1-7-6 Ef-
fective Date
This Ordinance shall
become effective upon
adoption and publication
as required by law.
