AN ORDINANCE
ESTABLISHING A
PROCESSING FEE
FOR MOBILE HOME
TRANSFER OF TITLE
AND MOVING PERMITS
PREPARED
BY THE JOHNSON
COUNTY TREASURER

Subject: Mobile Home
Transfer and Moving Fees
WHEREAS, pursuant
to Indiana Code
36-1-3-2, the State of Indi-
ana grants all units of gov-
ernment all powers neces-
sary for the effective oper-
ation of government as to
local affairs;
WHEREAS, County
governments have all
powers necessary to con-
duct the affairs of the
County even when not ex-
plicitly granted by statute;
WHEREAS, the Treas-
urer has seen an increase
in the number of mobile
home permit requests pur-
suant to Ind. Code
6-1.1-7-10 and each re-
quest for a permit requires
the expenditure of signifi-
cant time and labor by the
Treasurer;
WHEREAS, many
counties in the State of In-
diana currently charge a
fee for mobile home per-
mits and Johnson County
charges a fee for other
property-related transac-
tions;
WHEREAS, it is in the
best interest of Johnson
County that a fee be as-
sessed for such services;
WHEREAS, a fee of
$25.00 is a reasonable
charge for each mobile
home moving or transfer
of title permit issued by
the Treasurer;
WHEREAS, the Board
of Commissioners desires
to offset costs as a whole
to all taxpayers when a
user fee is more appropri-
ate for specific services;
and
WHEREAS, this Ordi-
nance does not rescind or
conflict with any previous
ordinances, state statute,
or federal law establishing
any other transfer fee or
service.
NOW, THEREFORE,
BE IT ORDAINED BY
THE BOARD OF COM-
MISSIONERS OF JOHN-
SON COUNTY, INDIANA:
SECTION 1. This Ordi-
nance is titled Mobile
Home Moving and Trans-
fer of Title Permit Fee.
SECTION 2. A fee of
$25.00 shall be charged
by the Johnson County
Treasurer for each mobile
home moving or transfer
of title permit issued by
the Treasurer. Fees col-
lected shall be deposited
into the County general
fund. The County Treas-
urer shall post the fee set
forth in this section in a
prominent place within the
Treasurers Office where
the fee schedule is readily
accessible to the public.
SECTION 3. The fee
shall be paid at, or prior to,
the time of the request. No
mobile home may be
moved from one location
to another unless the oc-
cupier obtains a permit to
move the mobile home
from the Johnson County
Treasurer. The Bureau of
Motor Vehicles may not
transfer a title to a mobile
home unless the owner
obtains a permit to trans-
fer the title from the John-
son County Treasurer.
