Hearing about Legal
Drain vacation, and ac-
ceptance of reconstruction
To be heard at 6pm,
July 7th, 2026, at its
stated meeting of the
Johnson County Drainage
Board.
Notice is hereby given
pursuant to I.C.
36-9-27-37, that a request
was received April 30,
2026 from John Gavozzi,
Managing Partner of UCP
Whiteland LLC, requesting
the vacation of the Canary
Regulated Tile, and ac-
ceptance of the recon-
struction (Canary Urban)
that was approved June
4th, 2020 as part of the
Project Hercules (Cooper
Tire) Petition No. DR-
3416-20.
The section of Canary
Tile begins on the White-
land Indiana Distribution
Facility LLC, AKA Cooper
Tire (41-05-23-
034-001.000-028) parcel
and crosses over the UCP
Whiteland LLC (41-05-
26-021-008.006-056) and
Exel Inc (41-05-26-
024-016.000-028) tracts,
ending at the headwall of
Canary Open Ditch
(approximately 2,400 Feet
in length).
The Canary Tile, north
of Whiteland Road was
previously vacated with
the Mohr Project. This re-
maining section had been
heard and approved for re-
construction under Petition
No. DR- 3416-20. UCP
Whiteland LLC is now re-
questing the vacation of
the Canary Regulated
Tile, and acceptance of
the reconstruction and re-
location.
Notice: That no less
than ten (10) days before
the boards hearing on a
Canary Tile Legal Drain
Vacation, an owner, or
owners agent, of lands af-
fected by vacation of Ca-
nary Tile must file with the
board written objections.
Each objector may file
written evidence in sup-
port of the objectors ob-
jections. The failure of an
owner to file written objec-
tions constitutes a waiver
of the owners right to sub-
sequently object, on the
grounds stated in this sub-
section, to any final action
of the board. On or before
the day of the hearing, the
county surveyor shall, and
any owner of land affected
by Canary Tile Vacation,
may, cause written evi-
dence to be filed in sup-
port of or in rebuttal to any
objection filed under sub-
section. The board shall
consider the objections
and evidence filed, may
adjourn the hearing from
day to day or to a specific
day certain, and may is-
sue an order permitting
additional written evidence
to be filed in support of or
in rebuttal to the objec-
tions and evidence previ-
ously filed.
Written questions, con-
cerns, and objections
must be written and re-
ceived prior to hearing in
care of the county survey-
ors office.
All filings shall be in
writing and filed in the Of-
fice of the Johnson County
Surveyor. This file and its
exhibits can be viewed
during normal business
hours at the office of the
Johnson County Surveyor,
